CALL TO ORDER: Mayor Hollis called the regular meeting to order at 6:00 p.m. and led the Pledge of Allegiance to the Flag.
MINUTES TO THE SEPTEMBER 12, 2022 MEETING: Page 4 under items for sale 2nd sentence changed the word sale to sell. Michael Schott made a motion to accept the minutes as amended. Art Nutzhorn 2nd, Donna Lefler absent, motion passed.
CASH RECEIPT REPORT: Total Cash Receipt for September 2022 is $186,744.27. Rob Finney made a motion to accept the Cash Receipt Report for September 2022. Ryan Kelly 2nd, Donna Lefler absent, motion passed.
TREASURER REPORT: The Treasurer Report for September 2022 is $1,614,910.40. Rob Finney made a motion to accept the Treasurer Report for September 2022. Connie Jacobson 2nd, Donna Lefler absent, motion passed.
REPORTS FROM CITY EMPLOYEES/COMMITTEE CHAIRMAN: Jake Streitmatter reported there was a water main break on Musselman St. The Sewer project, (lift station) Stark is done with all the digging, currently waiting on parts to proceed.
APPROVAL OF SUBMITTED CLAIMS: Rob Finney made a motion to approve the submitted claims. Connie Jacobson 2nd, Donna Lefler absent, motion passed.
ATTORNEY REPORT: Kate Carter was absent for maternity leave so Rob McCoy took her place. A failure to pay 2 ordinance violations were sent to collections. The sale to 413 E Jefferson is on hold because of issues from the buyer.
ORDINANCE #939 Vacate LaFayette St.: Connie Jacobson made a motion to accept Ordinance #939 an Ordinance Providing for the Vacation of Part of LaFayette Street Located Within Culbertson’s Western Addition to the City of Toulon. Michael Schott 2nd, Donna Lefler absent, motion passed.
LIFT STATION: Zach Knight reported that Stark has completed the main line, excavation, and installation. There is a hold-up on parts for the lift station. Stark has assured Zach that anything that can be done regards to restoration and cleanup will be done. Stark is doing testing, and everything is going well. Stark has requested the 3rd payment. Zach is reviewing it and will have it to present at the next council meeting.
SOLAR FARM: Jack Curry came to look things over, and he was disappointed it was a little hilly but didn’t think it would stop the project. The land would stay the way it is now as farmland for at least 2 years. So, the council needs to decide what they want to do, the housing development or the solar farm.
WATER TOWER GRANT: Zach reported he reached out for an update on the grant, and he was told by Friday, Oct 21st an update was needed on an estimated amount, engineering and inspection report, and a summary of the need.
BUILDING BID: There were 2 bids turned in. One was from Greiner Buildings, Garret DeSplinter $28,100, 2nd one is from Musselman Builders, Kenney Musselman $27,000.00. Michael Schott made a motion to accept the bid from Musselman Construction for $27,000.00. Art Nutzhorn 2nd, Donna Lefler absent, motion passed.
ORDINANCE #940 SELLING OF CITY PERSONAL PROPERTY: Michael Schott made a motion to approve Ordinance #940, Authorizing the Sale of Personal Property in the Possession of the City of Toulon. Rob Finney 2nd, Donna Lefler absent, motion passed.
There are several different surplus items that the city wanted to sell. The salt spreader, toolbox, and a parts washer. The bid for the salt spreader is from Andrew DeSchmidt for $50.00. The bid for the parts washer is from John McRell for $100.00. There were two bids for the toolbox. The first one is from Kenny Streitmatter for $25.00, 2nd one is from Chris Matter for $55.00. There was one bid for the PVC pipe and fittings from Streitmatter land Improvement for $1,005.00.
Chris Matter was the high bidder for $55.00 on the toolbox.
PUBLIC CONCERNS: None
HALLOWEEN HOURS: The hours are 5:00 p.m. to 7:00 p.m. on October 31, 2022.
CULVERT AT JEFFERSON & UNION ST.: Zach reported Farnsworth and city staff did an assessment on the culvert and the structural engineer recommends removal and replacement because of deterioration. He recommended the heavy traffic find another route until fixed. All of the council was in favor of Zach starting the process for the repair of the culvert. Michael Schott made a motion to put a sign warning of the danger of the culvert on Jefferson with a potential date of April 1st to start repairs. Ryan Kelly 2nd, Donna Lefler absent, motion passed.
FARM LEASE: The farm lease is up in December 2022. Mr. McCoy is going to have his firm look at the lease to make sure the 3-year lease is appropriate.
BACKHOE LEASE: The lease will be up in May of 2023 however; the John Deere company tells us that if you don’t make up your mind soon it may not be available when you want it. The City uses Bailey's vac service so much that it would pay the City to have our vac trailer. The Mayor asked the city employees to run some figures on what the vac trailer and a mini excavator would cost compared to leasing a backhoe.
OLD DIESEL GENERATOR: The fire department gave the city a diesel generator that nobody could get to run.

GENERATOR QUOTE AT MAINT. SHED: A generator is needed at the maintenance shed when the power goes out. Jake got 2 quotes. One from H & H lighting is for $11,266.54. The 2nd one is from RAB Electric on a Generac for $8,700.00. There is a 1-year warranty that comes with the Generac. Extra warranty costs more and the maintenance agreement is extra also. Michael Schott made a motion to accept the RAB Electric quote for $8,700 with the 5-year warranty given the free mobile link for $275 and the 3-year maintenance agreement for $450. BASEBALL DIAMONDS: Michael Schott reported that there should be some excavating done on the diamonds. The stairway going to the new concession building is deteriorating badly, and the hill side is steep and full of weeds. Matt was asked to get some pictures of what it might look like when finished. Need more information on the blocks etc. and hold this over until the November meeting.
ORDINANCE #938 (K. WALLACE/WALLACE ENG T.I.F.): The cost of the building for Wallace Engineering was more than the original quote so they are asking for $207.50 more. Michael Schott made a motion to approve Ordinance #938 AN ORDINANCE APPROVING AND AUTHORIZING THE EXECUTION OF A FIRST AMENDMENT TO THE TIF REDEVELOPMENT AGREEMENT. Art Nutzhorn 2nd, Donna Lefler absent, motion passed.
TIF: Rob Finney made a motion to pay FY2023-6 Quill for $106.04, repay Gen sav for $10,877.17, Sullivan Door for $187.50, for a total of $11,170.71. Connie Jacobson 2nd, Michael Schott abstained, Mayor Hollis voted yes, Donna Lefler absent, motion passed. 7:43
